Our partner Luiz Guilherme Decaro and Professor Heloisa Estellita (FGV) recently published an article titled “International Cooperation in Criminal Matters: some aspects of the cooperation procedure between Brazil and the Swiss Confederation” in the prestigious Revista do Instituto de Ciências Penais (RICP).

The text examines legal aspects of passive international legal cooperation through a case involving Brazil and the Swiss Confederation. Two main issues are analyzed:
i) the determination of the appropriate channel – letters rogatory through the Superior Court of Justice (STJ) or direct assistance by lower court judges; and
ii) the legality of obtaining confidential data for use as evidence in Brazilian criminal proceedings.
